Legal Question in Employment Law in India
Hi Sir,
I was working in software firm in Gurgaon, when I joined the notice period of 15 days was mentioned in my offer letter. I resigned from my ex company on 15 Sept but that resignation was not accepted by them, nor they released the salary of sept and oct, they kept me saying that the notice period got increased by 3 months, however no new offer letter was provided to me in the service period. On 1 Nov ,I stopped going to office and joined another firm also sent all the belonging of that office. On 10th nov my ex company, has dropped email to higher management of my present company stating that, It is the case of dual employment, and I didn't submitted company laptop while leaving.
Yesterday they sent back my old laptop saying that they will not accept it. They didn't issued and email or letter to me about missing property, nor giving me F-n-F.
Kindly suggest, I am too much depressed.

Dear Sir / Madam,
You should inform your new employer that your notice period in the previous Company was only 15 days and that you served the required notice period, Also inform them that the previous Company has still not given you your full and final settlement. Since the Company has not paid and settled your dues, you are legally right in retaining Company property till your dues are settled.
