My frn's father was working in a reputed MNC limited company. Recently under the extreme pressure by his boss as well the management team and also not being noticed by the company for his extreme hard work committed suicide in the factory premises. He was serving the company since 22 years and in spite of promoting him on time there used to be a long gap like 8 yrs, 6 years for a single promotion. Recently a guy which was having the same degree but experience in different companies was appointed as his boss. My frn's father was more deserving than him. HE LEFT A NOTE BEHIND STATING HOW THE MANAGEMENT IGNORED HIS HARD WORK AND NOT PROMOTED HIM DUE TO PERSONAL MATTERS.

Please guide in this matter. May he go to the legal system..what will be the pros and cons ? What type of compensation the family is eligible as the main earing member is no more due to the worst behavior of that company !! Please reply this sir. What is the right way to proceed ?

Dear Sir / Madam,

It is rather unfortunate that your friend's father took the extreme step of committing suicide in Office due to his hard work and not promoting him due to his "personal problems" as alleged. It is important to ponder and analyze on what were your friend's father's "personal problems" which may have led to his low self esteem and which had a forbearing on his job.

Moreover, an act of suicide resulting in death, although committed whilst in Office, is a deliberate act on the part of the employee, for which the Management may not assume any accountability nor responsibility.

The Company remains liable to settle all the legitimate service dues of your friend's father to the next of kin. Whether to provide any monetary compensation over and above the service dues remains at the sole discretion of the Company.

I do not recommend your friend taking any legal route, as you will only be wasting invaluable time and money, running behind Advocates and the Court without any concrete result. Instead, your friend should directly write a polite request letter to the Company seeking financial assistance in the form of monetary compensation from the Company for the loss of life. The letter may be copied to the Labour Commissioner for information and action.
