What is legal remedy to recover the Gratuity and leave salary amount if the

employer has not paid ?

Dear Sir / Madam,

Your first task is to approach the local Labour Commissioner and file your claim for unpaid Leave Encashment and Gratuity against the Company (Employer).

Gratuity contribution by the Company (Employer) is vested in a Gratuity Fund controlled and governed by the Commissioner of Charities of the concerned State in which the Corporate Office of the Company is located. Settlement of Gratuity has to be completed within 30 days the employee's last working date in the Company.

You should lodge your grievances to the Company and forward a copy to the Regional Commissioner of Charities seeking intervention and action. You may also lodge your complaint with the Registrar of Companies in case your Employer is a private / public limited Company for information seeking redressal of your grievances.
