Legal Question in Employment Law in India
I wanted to know about labor laws in probation period. I am ex employee of Serco global services, at the time of joining my notice period is 30 days but in probation it is only 7 days. From 15th Dec 2013 policy of company changed, notice period is extended from 30 days to 60 days. I resigned on 26th of Dec 2013 (before confirmation) and told my manager to release me ASAP, my manager given me 24th Jan 2014 as my last day in organisation. At the time of releaving my HR told me they want approval from our HOD so I co-ordinated with my sr. Manager he told me that he will take approval and forward it to HR. I have taken followup but HR not get any approval. He told me that if approval not comes then I have to pay 30 days gross salary, for that purpose my FNF kept on hold. I have my resignation email and resignation acceptance mail with date. Please tell me is notice period policy is applicable for me? also suggest me what to do if notice period wave off not comes from HOD.
