Legal Question in Employment Law in India
my wife is working in govt. school as a computer teacher on the behalf of a private organisation. but now they are saying,'
This is to reiterate that as per terms & conditions of your employment
you are only entitled to avail 1day leave per month and there is no
provision of long leave. You are therefore, once again informed that we
can neither approve your long leave nor can assure you of re-joining.
We, as per the requirement of department have to provide your
replacement to avoid heavy penalties. Your joining in future is subject to the availability of vacant seat, if
any.
so, what should we do. please suggest

Dear Sir,
The leave rules clearly stipulate that if your wife avails of long leave, her job on return is not assured since the school will have to appoint a replacement in her place during her leave.
