Legal Question in Employment Law in India

I am working at LTD MNC and I have resigned from my Job around 2.5 months before. As per the company policy I agreed to serve three months of notice period.

Now when 10-12 working days are remaining, I am getting pressurized to serve more than three months of Notice period ( May be additional one month ). As my company

is not willing to hear me to release, need your suggestion , so that I can prevent myself to serve more notice period. Please note that I have not taken any leave

during this period nor I have kept any work pending with me.

In case they get success to hold me, can I intimate and hence file a case against the company for the breach for company laws and employee harassment.

Kindly let me know.

Hello,

You are only bound by contract. One is not compelled to do things not written in contract.

So, for any illegal act by the company you can take legal action.

Thanks

Dear Sir / Madam,

In no way whatsoever can the Company compel or force you to work beyond the notice period. There is a famous business quote : "No Company has a future; only you have a future." Inform the HR Department to ensure that you get your final settlement and service certificate from the Company on your last working date.

Regards,
