Legal Question in Landlord & Tenant Law in India
i am 60yrs old man living with my wife, children & grandchildren in a rented flat.we have paid rs 3.5 lac to the agent of the owner of the house. We are living in the rented flat for last 21 months.Though our rented agreement expired last year, the owners agents have failed to returned the promised amount as per the agreement.now the owners have filed a eviction case again me.
Please advice me

Dear Sir,
First and foremost, you ought to have paid the money which may have comprised of interest free Security Deposit and / or the 11 months monthly compensation in advance, directly to the Owner, and not to the agent. Now since the Agreement for Leave and License (ALL) has already expired, and if it is not renewed by the Owner, you are a deemed trespasser in the flat. You should immediately get in touch with the Owner directly, look for another flat and tell the Owner to return back your remaining amount net of recoveries on account of pending dues, if any.

It was a rentout property or Gehne/Mortaged property. plz explain. better to consult any local lawyer alongwith documents.
