Legal Question in Landlord & Tenant Law in India
In case the Member/Tenant fails to renew the Leave & License agreement after expiry and the tenant continues staying in the premises,
1) What should be the society's stand in this case as per the Bye Laws
2) What action society has to take against Member/Tenant
3) Is there any time limit to renew the L&L agreement?
4) What fine/penalty society can levy on the Member/Tenant
5) Please share any other information related to the issue

1) Issue evacuation notice to the tenant and each day he continues should pay at the revised rate per day with interest e.g Rs.5000/- per day with commercial rate of interest depending upon the prevailing rate per day in a decent hotel charges.
2) Read ur bye-laws of the society and act accordingly.
3) Consult a local tenancy law expert advocate of reputation and take his advice while issuing notice.
