Legal Question in Landlord & Tenant Law in India
Dear Friends,
We are staying in Bangalore and living in leased house. We want to give up
this house, because that is not real owner of that house who has given us for lease.
That property is belong to his brother, his brother ran away due to building
seized. This guy broken this lock and given to us for lease.
We were not aware this incident. This fraud taken money from us. People use
to come us and asked us to vacate. Power has been disconnected at home because of huge amount due.
We have been politely asking our deposit amount to this guy but he says always false assurance.
We do not have proper Agreement document also with him.
Dear friends, please advice what action we can take to get hard earned money.

To return back your amount you have to file case against the person who has given the property on lease to you.

Dear Sir / Madam,
You ought to have checked whether the person to whom you gave the Security Deposit for the house you leased in Bengaluru, was actually the true Owner of the house before giving the money. That aside, I see no way that you are going to be staying for free all this while from the date you obtained possession till the date of your handing over the possession of the house back to the person from whom you obtained it. The monthly lease charges for the house are obviously and certainly going to be adjusted and recovered from your Security Deposit. So tell the person that you are leaving and request him to handover the net amount if any back to you.
Regards,
