Legal Question in Landlord & Tenant Law in India
Dear Sir - I am staying in rented appartment in Kolkata and heard that society is coming up with a new rule wherein all the tenants will barred from use of common facilities like swimming pool, club house and health club. Can a society pass such rule and restrict tenants from use of common amenities. I am staying in Kolkata.

Manish

Dear Manish,
A person who has obtained an apartment or flat on leave and licence from the owner and member of the Society remains entitled to all the benefits like car parking, club house facilities and swimming pool and all other common amenities as enjoyed by the lessor Society member.
Regards,
