Legal Question in Landlord & Tenant Law in India

Dear Sir,

I have rented my first floor apartment on a 20 Rupees stamp paper for eleven months. One of the term is "if the tenant fail to pay the rent for 3 months continuously" landlord can evict the tenant by serving one month notice. I did that but his argument is we have 40 thousand security deposit. Now that 40 thousand is going to last till March 14t 2014. I did not serve any other notice since I served them one earlier. I have the acknowledgement. If they continue to occupy even after the lapse of the deadline what action can I take? Shall I go through the lawyer to serve them legal notice to quit them? Does the tenant go to the court and continue to occupy the apartment? Please advice.

Dear Sir / Madam,

If the Licensee has repeatedly failed to pay you the monthly compensation, you should ask him / her to immediately vacate your premises, recover the total accumulated unpaid compensation from the Security Deposit, take the keys of your premises and handover the remaining amount, if any, to the Licensee. Should the Licensee fail to do so, lodge a Police complaint and initiate action.
