Legal Question in Landlord & Tenant Law in India
The ground and first floor of our house is jointly owned by my mother and my uncle(50:50). The ground floor is tenented. Now my uncle wants to forcably move into the first floor , which is not feasible. He is not willing to give an eviction notice to the tennant either on his own or even JOINTLY. IS it possible for my mother to individually file a suit of eviction for the tennant saying that both families cannot live on the same floor so the ground floor needs to be vacated.

Dear Sir / Madam,
If your mother is the owner (title holder) of the ground floor and your uncle is the owner (title holder) of the first floor, your mother has the right to issue an eviction notice to the tenant residing on the ground floor. Your uncle's authorization to your mother's notice is not necessary.
