Legal Question in Landlord & Tenant Law in India
hi,
my father in law was staying in a flat in mumbai for more than 40 years now. they are payinf regular rent. my father in law has expired recently. can you plesae advice me on the legal status of my husbands family with respect to that flat. can we apply for a title on that flat?

Dear Madam,
If your father in law has left behind a Will, the beneficiary of the "tenancy rights" named in the Will should approach the landlord to approve and permit the transfer of the tenancy in the beneficiary's name. The title of the flat cannot be transferred in your name till the landlord actually sells the flat to you.
