Legal Question in Landlord & Tenant Law in India

I had a land in kanpur which was acquired by kanpur development authority for making road, for the compensation of which i had put this case in front of high court in 2007 with the help of my lawyer from allahabad the lawyer since then had taken no interest in the same and due to his absence on respective dates when called by the court the case was dismissed, this information was given by his office boy to me, i want to ask a question --in this case i have heard from my friends that until the same layer re starts the case i cannot hire another lawyer, sir is it so... if such situation arises what should i do as the lawyer from allahabad is still taking fee from me and i don't want to continue him now

Dear Sir / Madam,

There is no such rule of the Bar Council of India that you cannot appoint another lawyer and have to pursue your case with the same negligent lawyer. You are free to immediately appoint another Advocate to represent your case and you should discontinue paying any fees to the present lawyer. In fact, you even have the option to lodge a complaint for negligence and lack of professional etiquette against the lawyer and level charges against him / her at the Bar Council of India to be debarred from practice.
