Legal Question in Landlord & Tenant Law in
In Mumbai a single unmarried lady stayed at the premises and she died intestate. Can a cousin brother claim deemed tenancy when a real brother is living but settled in the States and not willing to come to India, but gives his consent to the cousin brother to claim tenancy. The landlord is not accepting the cousin brother as his tenant. None of the brothers were ever staying at the premises. It is proved that the lady has carried out unauthorized construction at the premises, without the permission of the landlord, and the Municipal Corporation has issued notices and proceeded with demolition work at the premises. Please enlighten and oblige.

it is for landlord to accept you as tenant or not as you were not living with your sister at the time of her death.
