Legal Question in Landlord & Tenant Law in India
.We have given our property on rent for residence purpose in the month of June 2014. We have agreement with us. Property is in Mumbai.
Now tenant want to vacate the residence due to water shortage. We have no objection to it.
We told him to vacate the house and the day when he handovers our keys we will pay his balance deposit in cash if he does not want cheque.
But he want his deposit first to be given to him, then after 5 days he will vacate our rented house.
We don't have trust that he will vacate our house even if we return his deposit. Since last two months he has not paid rent also.
Please suggest us solution for this issue.

Deducting every dues you can handover their balance to him with agreement.
