Legal Question in Landlord & Tenant Law in India

Sir, we have a well in our property which is mustrika (shared) by us and our cousin. A third party has laid permanent line from his hotel to our well and fixed a motor to draw water with the permission of our cousin but did not seek our permission. We are staying 12 kms away from the properly. On discussing this with the third party he said that he had spent around 15 thousand on the maintenance of the well and asked the permission to draw the water for 2 years. At that time we gave the permissions on humanitarian gronds. He said he will remove the GI pipe line as well as the motor pump by March 2013. Now even on our request they are not removing the motor from our well. Initially when the properly was divided we were the owners of 3 parts from the 5 parts of entire properly. Can a third party fix a pump on the well without the permission of both the owners? Please suggest whether this case can be fought legally?

Dear Sir / Madam,

You should lodge a Police complaint for "illegal trespassing" into your property and to get the third party to dismantle the pipeline and stop drawing water illegally from your well.
