Legal Question in Landlord & Tenant Law in India
We are two sisters and one brother(myself)-legal heirs to our Late Mother who left behind a flat registered and mutated in her name.Some years back my younger sister gave out the flat on Leave and Licence rental to a tenant on notary affidavit agreement.Now we three children have decided to sell off the flat and share the proceeds equally,and hence,looking for suitable buyers now.However,the tenant is showing no signs of vacating,although the last agreement has expired on 15th Dec'13 and he has been repeatedly put on notice verbally.As a result,I am unable to proceed with the sale.What course of action is advised in this situation?

serve him with a legal notice and file a suit for possession against him.
