Legal Question in Legal Ethics in India
hi i am employee of genpact i left the company and i m suffering from dysphonia and migraine and doctor adviced me to not to work in night shifts and also in the calling process i told this thing to my management that i would not able to serve the notice period. I submitted my resignation along with the medical documents. But Managers are threatening me to file a law suit against me and asking me to either serve notice period or pay me the huge amount. They also said that we will mark you as absconded employee. Plz help me what should i do ? i have worked here for 1 year, already covered probation period of 6 months and did not signed any bond with the company. Did not went any training that they are charging such a huge amt from me. Also i am poor guy and dont have any source of Income. Also i am very sick and my family is entirely dependent on me. firstly,you have to talk to your senior management like hr and operation management plus incharge -management of your branches for solve amicable and will write letter to all under register-post.
As per our constitution, give fundamental right like right to work and other. if you have truly excuse or problem.nobody can be bound. otherwise you have to advise labour commission .
