Legal Question in Medical Malpractice in India
Is prescribing medicines to patients through online consultation illegal in India?
1 Answer from Attorneys
To prescribe a Medicine, one must have necessary qualification. If you are having necessary qualification then you can do online consultation and prescribe medicines, otherwise not.
To prescribe online is not per se ILLEGAL. But at the same time, it may amount to Medical Negligence, because, before prescribing, there may be situation, where a doctor need to physically check the patient, verify physical symptoms, and carry out other investigations. In such situations, prescribing medicines without proper examination, may amount to Medical Negligence / Torts, but not ILLEGAL per se.
Feel free to ask, should you have any questions.
