Legal Question in Medical Malpractice in India
Sir.
My sister has registered for cancer treatment in Delhi AIIMS ON 17 DEC13.ALL INVASTIGATION HAS BEEN FINISHED.THE ONCO SURGERY DEPARTMENT HAD GIVEN17MARCH14 FOR OPERATION.WHEN WE REACHED ON 17 MARCH.THEY POSTPONED TO 18 MARCH .WHEN WE REACH ON 18 MARCH NXT THEY POSTPONED TO20 MARCH.WHEN AGAIN WE REACH ON 20 MARCH THEY AGAIN POSTPONED TO 27 MARCH THEY HAVE ONLY ONE ANSWER THAT BED IS NOT EMPTY.Patient is now depressed because she has been passed 3 month from the confirmation report is out by AIIMS ON 27 DEC13 .PLEASE TELL ME IF I CAN TAKE A LEGAL ACTION AGAINST AIIMS @HOW.

file an application under the RTI and ask for the reason for delay? and also the allocation of beds were given to patients with what ailment. You can also ask them if operation for cancer is not a serious ailment and should not get preference while admitting patients. After you get a reply you can file a writ petition against them.
