Legal Question in Personal Injury in

Is the dealer liable?

arear end collision resulted becaue my new car died while at an intersection (this is a recurring problem at less than 5000 miles. Car was towed to the dealer who estimated collision damages and said the engine was cutting out becaue of faulty spark plugs which came with the car. They released the car to me after a "road test" Less than 10 miles later the rear end drive train housing cracked completely rendering the car inoperable and out of control. Even if tghe car were fixed which may take 3 months, i feel uneasy driving it. The other guys insurance will take care of damages, But do I have grounds to ask for a new car from the dealer?
