Injury
While on vacation in the BVI, I fell down a steep incline at the resort that I was staying and broke my wrist. I was out of work for ten weeks.

Presuming BVI is British Virgin Islands there may be a way to sue in New York under long-arm jurisdiction. Your lawyer would look carefully into whether the hotel or booking agent has business contacts in New York State, an office, a telephone number, a mailing address, etc. If sufficient contacts exist, New York courts might have jurisdiction to hear a case.
