Legal Question in Real Estate Law in

We are 4 brothers and one sister. My father died in 2008.

We have our own house and some plots and some deposits in Bank.

Now as all are married and settled, we would like to devide our property.

House is in the name of my mother, plots in my fathers name. My elder and younger brother stays with my mother. I am staying separately for sake of job.

Now can I ask my share in the property? or as because I stay out of house I can not get share?

Please advice me. I am a private job holder.

you can ask your share and if need be, file a partition suit where your mother, you, your brothers and sister hold equal share.

Again, if father died intestate - without leaving a Will, you may do so for your right.

You may claim a share in your father's property but in the property which is in the name of your mother till she is alive.
