Legal Question in Real Estate Law in India
In 2010, I had surrendered vacant and peaceful possession of a slum dwelling unit along with about 273 other slum dwellers to a developer under a Slum Rehabilitation Scheme. The unit was not in my name but i had uninterrupted possession of the same since 1993 and had used it for commercial purposes. There were many such unit holders in that slum colony. The developer, while taking possession, had promised to make us eligible at his own cost and should he fail to do so, he promised to give such 'ineligible' holders, shops from his own sale area.
The building is ready now with OC procured by the developer from BMC. He has called me to take possession of a shop in lieu of my old unit. The approved plan shows that shops have been earmarked on the ground floor as his sale area. But he is refusung to enter into any agreement for this deal. He is just giving a possession note that will be notarised. Is this sufficient to protect my righte and entitlement? Is there any threat that I could be dispossessed of this shop any time in future?
