Legal Question in Real Estate Law in India
Hi,
I'm Abhishek, working with IT company.My Query is regarding the property which is described below
"My Father bought a land in 1978 on power of attorney because registry option wasn't available that time, On that land my father made a 2 floor house. currently, we all staying on ground floor and my uncle (Cacha ji) staying on first floor. Now, In Feb 2013, my father was passed away due to sudden heart attack. after my father, we have transfered the our property to my mother and made a RD (Req. Deed). Now my uncle wants to sell this house completely but my mother and we don't want to sell this...So my question is
1. My uncle (cacha ji) has any right to adopt 50% share of property?
2. if it is, can we give 50% amount of property to my uncle and acquired all the rights of the property?
You advice will be great help to us

Your uncle has no right on the property, since this is your father's self acquired property, unless your father has given a share to your uncle.
