Legal Question in Real Estate Law in India
I just saw the answer received on Law Guru from Rajiv Gupta of your Office.
The answer is not clear to me. Let me reproduce the Question here
Being a sister, I have given relinquishment deed (RD) to my brother in respect of my father's property in Gurgaon during May 2005 but the same was not registered. However, the Conveyance Deed for the property in favour of my brother is already done in 2011.
Now my brother behavior and relationship is not good with us and my son is asking for his share as my legal heir. Can I get back my share though the brother has done the Conveyance deed already on the basis of that unregistered RD.It has come to my notice that my brother is selling the said property. Pl advice.
The response from my brother is that since I have already given the relinquishment Deed and the Conveyance Deed has been done on that basis in 2011, you have no claim whatsoever on this property.
[ there was a cash transaction also which is not on record]. My question is that now the property value has gone up many fold and therefore my son wants me to get the equitable share. Can I claim the share now?
