Legal Question in Real Estate Law in India
In our apartment building some flat owners have encroached in common area by fixing shoe racks on common area. All such activities are creating nuesance to other flat owners. We have a association (but not registered yet) and they initiated to remove but no use. How to proceed on this? Please advice

Yes, very true. Common passages and corridors are the property of the Society. No member is allowed to or supposed to keep any personal belongings like shoe racks, plant pots or bicycles outside their door as it becomes a hindrance for members and people walking in the building. You should instruct the sweeper that whatever is kept outside the door by members in the common passage on each and every floor, and corridors of the building is "bhangaar" / garbage for disposal and has to be immediately cleared away. You should also write a strong letter to the Chairman / Hon. Secretary of your Association to immediately initiate action, failing which you should lodge your grievance with the Registrar of Co-operative Housing Societies to intervene and resolve the matter.
