Legal Question in Real Estate Law in India

Above my bedroom is a private terrace, from where there is heavy leakage every rainy season from last 3 years. I approached owner as well as society. Society refused to act in a case saying its should be sort out mutually. And private terrace owner said I why should I should I bear a repair work. This year from last 2 weeks my bedroom was heavily leaking damaging the ceiling fan and owner is not responding my phone calls also. Above flat owner is having a garden and also kept the washing machine saying outlets are proper and wash the terrace on frequent basis.
Please confirm (Flat resides in Dombivali Residential Zone.)
1. Who is responsible for such repairing work and its charges.
2. Bye Law no. for supporting the issue of private terrace
3.Can the terrace used for above said activity.
4.Next authority to approach if society and owner is not responding.
