Legal Question in Real Estate Law in India

I booked a flat which was supposed to be delivered in Dec 2012 but till yet not.I took the home loan from LIC and as the ROI is high, I want to chnage to other Banker.But my builder is saying that they lost the doc for that apartment and is not giving the docs for processing the home loan with a new Bank.

Following up with them through Phone and Email for the last 3 months.

Can I go for legal action?

Yes, you should firstly serve a legal notice and if that does materialize, file a consumer complaint. The refusal on the part of builder certainly constitute deficiency in service.
