Legal Question in Real Estate Law in India

I bought a re-sell flat in Gurgaon, posession is delayed by the builder (2years) . When we ask them for penalty; they say the penalty clause is not for the second owners. Please advise what should we our next step.

It depends on the agreement. Still a case for compensation is made out on account of delay in delivery of possession. Non delivery of possession in time amounts to deficiency whether its a first buyer or second. The legal notice will be followed by a consumer complaint.
