Legal Question in Real Estate Law in India

My Brother bought the flat in india for business porpose he for Handling the business in other city he bought the flat as he is the prime owner and with 2nd he put the name of the employer because that person was looking the business of perticular city.he was living in the flat and looking for the business since 12yrs,that person is not our relative or not from our own caste,but that person left out our firm and doing for another firm business using that flat for resident plus commercial use for another company.Now my Brother died almost year back,That person is refuse to leave the flat.

What was the status of deceased Brother and sister.How to claim .How to get it.
