Legal Question in Real Estate Law in India
one of three brothers went to court for partition of house property. Compromise not arrived at the "out of court". Now the properties went to court for auction. What will be the starting rate (guideline value or anyother value) of auction? Will the properties be auctioned for market rate or not??
Is it advisable to go for auction to get better rate of the share of property or not?

Dear Sir / Madam,
You should specify the "minimum reserve price" (which should ideally be the prevailing market price) for auction of the property by the Court. Yes, if the Court takes into consideration your plea for "minimum reserve price" it is advisable to go for Court auction.
