Legal Question in Real Estate Law in India
THIS CASE is pertaining to property in Himachal Pradesh.
In this case there is an ancestral property which had 7 shares as under:
3 brothers, 3 sisters, and old mother.
Old mother by way of will bequeathed her share of property to the son who stayed with her and looked after her. Other 3 sisters and 01 brother also relinquished their share in property to whom mother had bequeathed thus enabling to have total six shares.
Share of 01 brother is left who is dead and the property is mutated in the name of his legal heirs namely, widow, major son and daughter.. Widow of this brother is always saying that she does not want to have anything of this property and the property can go to the one who has got the complete property .
My question now is as under:
The widow of the brother resides in any other city and cannot travel long due to illhealth her son is always tours in foreign countries on official work and daughter is settled in USA and all cannot come to the place of property to get the legal work done. Can ou guide me what is the way to get the property transferred in the name of the person who has other shares.
What will be the mode of this transfer Sale Deed or Gift Deed.?
Can this transfer be done on GPA /SPA.

you can get the transfer done by the sale deed and they can issue a special power of attorney in favour of a person who can get the sale deed registered. for further queries contact 9312411481.
