Legal Question in Real Estate Law in India

In a civil property related case, where we signed a MOU with a builder who agreed to build a house for us in lieu of us selling 25% part of the property to him for 50 lakh rupees. The builder showed this MOU to a financer and took 2 crore rupees from him in lieu of the 25% part of the property which he will get from us and sell to financer for 2 crore INR. But the builder failed to build the property as per MOU agreement, hence, no sale happened to him. Now the Financer has filed a case against both the builder and us the owners of the property. Do you have any reference of any similar case from india, where the owner was let off the hook, as the owner didnt get into any agreement with the financer. and that the financer only had a deal with the builder and not the owner?

there is no priviy of contract between you and the financer and it only exists between you and contractor and contractor and financer.
