Legal Question in Real Estate Law in

Dear Sir,

I want to give my property on rent. I have heard that instead of entering into lease agreement its better to enter into Leave & license agreement with tenant as it will not create any legal problem for removing the tenant.

1. Whether I can enter into such agreement in Delhi?

2. It is better than Lease agreement or not.

3. What are the pros & cons of such agreement.

its better to enter the lease agreement if the rent is more than Rs.3500/- as its easy to get the property vacated after giving notice of termination as per lease. if leave and licence it has legal hassles and the defense which generally comes of tenancy, so its better to have a direct lease deed registered if more than 11 months

you have not mentioned the amount of rent and the period of tenancy. whatever agreement that is to be issued, has to be in consonance with the existing laws and in case it is tenancy, the regular norm should be followed instead of going for leave and licence agreement.
