I had entered into leave and license agreement in which had the following clause:
That as per the provisions of Section 24(2) of the said Maharashtra Rent Control act, the said LICENSEE shall therfore be liable to pay to the said LICENSORS enhanced charge of Rs.36000/- per month, if he fails to vacate the said Flat on or before 30th June 2010 and shall be also liable for prosecution...etc.
Due to non readiness of my own flat that I had purchased, I could not vacate on 30th June 2010 but could vacate only on 4th July 2010 ( a delay of 4 days). I had spoken to the landlord to extend the deadline by 15 days but since he wanted to sell his flat he insisted that I vacate immediately.
Upon vacation on 4th July 2010 he has deducted Rs.36000/- from my security deposit of Rs.125000/-.
My view is that he should have charged the enhanced charge only for 4 days and not for entire month.
Please give your views.
