Legal Question in Real Estate Law in India
We have family property but there is a dispute on it because of that we will loss our rights on that property. my grand grandpa did not devid their propety, they had two son (my grandpa and their brother) After the death of our grand grandpa whole property got registered in the name of granpa's borther. my grandpa was retired from their service when they decided to devid theire property . That time my elder uncle was only person who was in govt service (only person who was earning) , my father and my other two uncle were minor at that time. So my grandpa's brother decided instead of giving the property to my grandpa he transfered whole property in the name of his eldest son (my elder uncle) . Now we want to put my father name and other two uncle name on the property bur our Talathis (person who manage the records of land owners )says this property was transfered by your grandpa's brother to your eldest uncle so we can not put yours name on the property. He also said Now this property is belong to your uncle and we can not consider your rights on this property.
Please help me with this. Actually this property belongs to my grandpa and we have equal rights on it. Our property directly got transfered by our grandpa's brother to my elder uncle that is why grandpa's name is not in the list of chain of transfer of property. now it is very difficult for us to prove that this proprty belongs to our grandpa and our elder uncle is not the whole and sole of the property.

Dear Sir / Madam,
You will have to file a suit in the Court challenging the basis on which your grandfather's brother transferred the property in the name of your elder Uncle and asking that the property be partitioned so that all legal heirs get an equal share therein..
