Legal Question in Real Estate Law in India

My father had bought a land in Odlabari, which is situated in West Bengal, around 30 years back. He had put the ownership of the land under his mother. But she died, couple of years of later. And there was no change in the name of the property to any of his other brothers and sisters. We want to transfer the land now in my father's name. It can be assumed that ownership papers are misplaced, and documents have to be gathered. Also, please note that my father is a British subject, since he was born before India's independence. Can the property be transferred to his name, or my name? I am his eldest daughter.

1) The property can be transferred to all legal heirs after collecting the relevant documents.

2) U may hv to file declaratory suit for title thereafter only mutation.
