HI , my father had sold ancestral property which he got from his father ,who in turn got from his father.(the property was made by my father's grandfather). my father sold 1 part of it to agent in 1990 and another part in 1994. when selling the 1st part, my mother was carrying my sister in her womb. (around 5 months baby and i was not yet born) , when selling the 2nd part ,my sister was 4 years and i was 2 years old child. my father had not told about both the sales to my mother and even he did not take any court permission to sale , he has mentioned in reason for sale as "for business purpose".
he had also made registered sale only.
we were minors then and we(mother also) were not know about dis . in municipality ledger , both the sold property were in my dad name only , so we were in imagination that both parts are in with our family only. the purchaser has not given for change of name.
we were only paying revenue for that 2 parts.
but this time when we went to pay revenue, the officer told that those two parts belongs to that agent and he has given letter to change the name with sale seed copy attaching . we were shocked and asked our father. he accepted that he has saled those 2 parts to that agent. we went to that agent asking our share. but he denied to give and sent us.
1) do we (me and my sister ) have rights on those sold 2 parts of the property.
2)since the property were sold before 2004 through registered sale ,does my sister has the right on those property?
3)since the 1st part were sold before my birth,do i have the right on that property also?
4)now i am 20 years old and my sister is 22 years old.
5)does my sister gets share in 1st part since she was in womb .
6)property is in karnataka.
we were not known about all this, we just now got .
