Legal Question in Real Estate Law in Pakistan
My father transferred his some of the property at my ex-wife name by using a sales deed in yr 2005 attested by a notary public and even witnessed by my brother��now after the death of my father can she use the sales deed to get the property transferred at his name hence interrupting the process of WIRASIT.
Sales Deed is over a two stamp papers of Rs. 500 each, and it seems unregistered too.
the property is at Ali Pur......and it was not worthing at that time but now its valuable further more the documentation is carried on at Karachi.

It the sale deed is valid, the property may be transferred to her name. Rest of the property will be subject of virasat. It is immaterial where the sale deed was executed. What it requires is to be valid only.
