can i file partition suit for my real unmarried deceased chachaji's ancestral property.what if the contested mutation case is already running before SDM for the chachaji's property.can get stay on land even if the case is running before SDM.thanks for any reply in advance.

Dear Sir / Madam,
Your chachaji's wish or last Will prior to his demise backed by a Probate will prevail. While the case is running before the Special District Magistrate, the plaintiff / respondent can file an addendum requesting for stay on land till the final judgement is delivered by the Court.
