Legal Question in Real Estate Law in India
I have a flat given on rent in Mumbai. The society , in addition to 10% extra on service charges has been charging Rs 500/ PM more for open space car parking ie Rs 600/ as against Rs100/ from the resident members, Rs 400/ PM more on service charges and now they have asked for an interest-free deposit of Rs 40,000/. I would seek opinion, how to handle this kind of illegality.

1) The non-occupancy charges not more than 10% of the service charges, excluding property taxes, both in respect of residential as well as commercial premises, irrespective of the fact whether the new Bye-laws are adopted by the Societies or not.
2) What for the deposit may be ascertained from the society whether it is within the bye-laws. It should be discussed in the General Body and passed. If found unjustified, lodge complaint with the Registrar of Societies.
