Legal Question in Real Estate Law in India
My grand father,s property has been disposed of by my father and his 3 brothers at a throw away price.I was not consulted for this,but my 2 brothers got share from this post disposal.They(Father + 3 brothers) have 3 sisters also of which 1 is no more,they were not given any share from the property disposal money.
My grandfather had property at 2 location ( lets call these property A and B for simplicity.) and what these brothers did is they gave property B to 1 brother in lieu of share arising from disposal of property A.
My question is:-
1) can i file a case for stay order in the case of property A and get this declared NUL & VOID ?
2) can a stay order be also taken on property B for my share?
3) can a case under section 420 be filed against both (Buyer&seller;)as the consent of sisters,who are still alive,was not taken by both the parties ?

i have already answered your question earlier. yes you may file a civil suit against the brothers as you and the sisters also have a right in the property you can make the present owners a party to the suit and take a injunction that no further transfer should take place further you can also file a suit for declaration. for further query contact 9312411481.
