Legal Question in Real Estate Law in India
My grandfather has come to his age.The property he owns has to be divided amongst his 4 sons which includes marriage house and remaining land, couple of shops and his own house. But the eldest son is creating nuisance asking for share as like he wants. And is not ready for the share he is getting according to what my grandfather and other members are deciding.
How to come out of this situation ?
1 Answer from Attorneys
If the property of the Grand Father is his Self - Acquired Property, then grandfather can divide the share the way he wants. He is not bound to divide the share as per the wish of eldest son. Also, if Grandfather wants, then he can also deprive his elder son from giving any share. You do not need any consent of the Elder Son to make a family settlement / partition, So let your grandfather just execute a Family Settlement. This will be sufficient, And yes, get this family settlement registered.
