Legal Question in Real Estate Law in India
My grandfather`s property is in Chennai. My grandfather passed away without leaving a Will. The property was in dispute and the matter was taken up with the Court. The Verdict given by the Court is that the property should be equally divided among my father and his brothers. My father passed away 20 years ago. Legal Heir Certificate was not obtained by us. Now we are planning to dispose off the property and share the proceeds equally. Kindly advice me whether we should obtain Legal Heir Certificate now after 20 years of father`s demise or Succession Certificate. I reside in Chennai and my sisters reside in Secunderabad . Is it possible to obtain the above certificate for my sisters in Chennai itself ?

1) There is no necessity of obtaining Succession Certificate. Legal Heir
Certificate will be asked by the Registrar for Registration.
2) Obtain Legal Certificate at Chennai where ur father lived and expired.
Ur sister is not required for this purpose. Revenue officials enquire and
issue certificate. No need of ur sister unless they ask.
