Legal Question in Real Estate Law in India
Hello,I own a flat in Thane which & housing society is not yet formed.I have paid 2 years maintenance charges to builder who is currently managing housekeeping & other things.Please do let me know if builder can charge us Non occupancy charges if i owner has rented out flat.

Dear Sir / Madam,
The Builder is required to act as the Chief Promoter of the Society and all monies collected from members on account of Maintenance charges and other charges have to be deposited in a separate bank A/c till the Society is formed. This bank A/c will be deemed to be the Society A/c as soon as the Society is formed.
