Legal Question in Real Estate Law in India

sir me and my mother are going to pay home loan and mortgage loan which was took by my father......but we want that before paying loan we shuld make a legal document like stamp paper document or affidavit non judicial......in which it shuld be mentioned that after paying or settling loan with bank by us .....my father will transfer property to my mother name........if he willl than also nt then there will legal action .....i want to take advice that we shuld agreement we shuld make an d ih fom and m where will it make like lawyer or any vasika navis...we are from amritsar punjab

Dear Abhishek,

Your first priority is to settle the bank loan and take a no dues certificate from the bank. Thereafter, you should proceed with the process of getting the nomination of your father filed with the Society.
