Legal Question in Real Estate Law in India

Hi,

I and my current roommate are renting a flat together.

The rent agreement that is to be made is being made with the name of my roommate only as the Licensee because she wants it to be by her name as she said it needs to be submitted in the bank.So is it that that the bank does not accept rent agreements with the names of people staying there?

Is it necessary that only her name as the Licensee should be there only then will the bank accept it?

The reason she gave me is that she does not want my name on the agreement because it is needed to be submitted in the bank.

What could be the reasons for she not agreeing to make only one rent agreement with both our names as Licensees?

I have asked the Broker to make another agreement with our names as Licensees.

I informed her that I am making this another agreement ,at first her reaction was that you do whatever you want and then I told her that I need my residential proof and I need to submit it to my required places she said ok you can make it.But then it seems she is not going to share the money for this rent agreement which includes both of us as Licensees.

How should I explain her to share the money.

Is it right that she is making her set of agreement with her name as Licensee and me making another one as both of our names as Licensees?

Thanking you.

Dear Madam / Sir,

There cannot be two Agreements for Leave and License (ALL) for one premises at the same time. Usually, if two persons are taking any premises on ALL, it is made in the name of the person who gives the Security Deposit to the Owner. So if your friend has given the Security Deposit to the Owner for acquiring the premises on lease, tell her you accept it. If you have given the entire Security Deposit, simply tell your friend that since you are giving the Security Deposit to the Owner, the ALL will be in your name. In short, the person who pays the Security Deposit will have the ALL in her / his name.

Regards,
