Legal Question in Real Estate Law in India
Hi,
This is krishna prasad, This case pertaining to partition suit. Currently case in the stage of final decree proceedings where court commissioner appointment is pending and subsequently the partition as per the order.
Currently my uncle has encroached the land premises by showing final decree previous order stating order has been passed ( Ie 1/2 share). But exact location is not earmarked by any one. Is it a offense ???.
Earlier we have not raised any injunction or maintain g the status quo?

Your uncle has taken law in to his own hands, which he cannot do.
File a complaint against him, and draw Civil Courts' attention towrds his conduct by taking out an application in the matter.
